I had the pleasure of observing a hearing on motions to dismiss this past Wednesday (1-14-09) over which Judge Rakoff presided. The case, a complex shareholder's derivative suit, raised a number of particularly thorny procedural and substantive issues.
I was quite impressed with Judge Rakoff's mastery of the applicable case law (all of which he had apparently read), the factual nuances of the decisions and how they applied to the circumstances of the case before him. Despite the arduous task he faced in dealing with this exceedingly complex case (there were 40 lawyers in the courtroom), he dealt with counsel and the arguments with good-natured humor and respect...even when he disagreed with certain of the positions taken.
He is a credit to the Bench and I look forward to a case where I will appear personally before him.
