Hayden was first elected in 2008, opting to run after incumbent Rep. Neva Walker decided not to seek re-election. He was re-elected in 2010. He is currently vice chair of the House Rules and Legislative Administration Committee, and is a member of the Health Care and Human Services Policy and Oversight Committee. He also serves on the Finance subcommittees for the Health Care and Human Services Finance Division and the Housing Finance and Policy and Public Health Finance Division.

On July 25, 2011, Hayden announced that he would run in the October 18, 2011, special election to fill the state senate seat that was vacated by Senator Linda Berglin
