The school fought the accusations, but on October 8, 2010, the Department decided to strip the school of the nickname and logo. After much controversy, Mukwonago High School returned to court a year later, and the claim of having to change the school's mascot due to it being "race-based" was announced unconstitutional. Mukwonago High School was permitted use of the Indian logo and mascot.

In March 2011 the Mukwonago High School Marching Band made the announcement that they would be changing their name to the Phantom Legion. Along with the name, the band changed their identity buy investing in new uniforms.
